El fenómeno de piratería de marcas completamente desatado e incontrolado en Venezuela está generando ya consecuencias peligrosas para la salud pública.
El Instituto Nacional de Higiene «Rafael Rangel» emitió una alerta sanitaria para recomendar no usar cremas dentales que se comercializan con la marca Colgate en las presentaciones «Triple Acción» en presentaciones de 90 y 145 gramos; «Total 12» de 90 y 180 gramos; «Colgate Menta» en 90 y 100 gramos; y «Max Fresh» en 140 gramos.
La entidad, adscrita al Ministerio de Salud, inició el procedimiento de investigación por denuncia de la propia empresa Colgate Palmolive CO., que informó «y demostró a la institución que los lotes cuestionados no fueron fabricados, comercializados ni guardan relación alguna con la compañía».
El Instituto «Rafael Rangel» realizó pruebas de control de calidad a una muestra científicamente aceptada de los lotes cuestionados y encontró contaminación microbiológica y ausencia de fluoruro, elemento básico para la protección dental.
En consecuencia, el Instituto resolvió:
«El INHRR alerta a la población venezolana a no adquirir ni usar los productos señalados en el ANEXO 1. Si está utilizando alguno de los productos descritos:
a. Suspenda de inmediato su uso, debido a los riesgos que puede representar para su salud.
b. Denuncie los lugares o personas que lo distribuyen o comercialicen a través del correo electrónico: alertasinhrr@gmail.com TWITER: @INHRR_Vzla, INSTAGRAM: inhrr_venezuela.
2. El INHRR recomienda a los consumidores adquirir en establecimientos comerciales y debidamente constituidos, solo productos que cuenten con permiso sanitario, ya que esta condición permite realizar el seguimiento del lote adquirido.
3. El INHRR exhorta a los establecimientos titulares, importadores, distribuidores y comercializadores a adquirir Productos de Uso y Consumo Humano a través de proveedores Certificados y Autorizados por el MPPS».
Igualmente, «el INHRR notificará al Servicio Autónomo de Contraloría Sanitaria (SACS) y a la División de Delitos Contra la Salud Pública del Cuerpo de Investigaciones Científicas, Penales y Criminalísticas (CICPC) para que tomen las acciones correctivas pertinentes».
El problema de piratería de marcas ha sido advertido por varios profesionales del derecho y empresas fabricantes de productos esenciales. No solo Colgate ha sido afectada por esta práctica, cuya incidencia es más notable en comercios del interior del país, aunque está extendida por toda la república, sino por otras corporaciones, como P&G, que mantiene un programa permanente de supervisión en cadenas comerciales.
