Melissa Lucio, estadounidense de origen mexicano, se encuentra desde 2008 en el corredor de la muerte y está previsto que el 27 de abril sea ejecutada en Texas, EE.UU, por la muerte de su hija, Mariah, de dos años de edad. Durante más de 14 años, Melissa, que podría ser la primera mujer de ascendencia latina en ser sentenciada a muerte en este estado, ha mantenido su inocencia.

Un jurado del condado de Cameron, Texas, la acusó de matar a golpes, en 2007, a Mariah. Pero abogados y activistas defienden que la pequeña tenía una discapacidad física leve que le provocaba inestabilidad al caminar y era propensa a tropezarse.

Según su versión, la niña se cayó por unas escaleras cuando la familia hacia una mudanza. Sin embargo, dos días después, se echó una siesta y no despertó. Sus padres llamaron al servicio de emergencias 911 al ver que no respiraba.

Varios documentos presentados avalan que el médico forense determinó que la pequeña sufrió un «traumatismo craneoencefálico» a causa de la caída.

Tanto la defensa como ‘The Innocence Project’ –organización que busca exonerar a presos condenados injustamente– denuncian que el estado de Texas no presentó ninguna evidencia que estableciera que Melissa, de 53 años, abusó de Mariah o de alguno de sus otros hijos.

«Miles de páginas de los registros del Servicio de Protección Infantil demuestran que Melissa nunca fue violenta con ninguno de sus 12 hijos», explica en un comunicado la organización, que pide la detención urgente de su ejecución.

«Interrogatorios coercitivos»
Según la ONG, Melissa fue condenada en base a unos «interrogatorios coercitivos» y «en presencia de detectives armados» que, sin investigar las causas de las lesiones de la niña, «inmediatamente llegaron a la conclusión de que había sido asesinada».

«Dijo lo que los investigadores querían escuchar para detener las preguntas», destaca el texto, que recuerda que «las confesiones falsas bajo coerción son una de las causas principales de condenas injustas».

Melissa, que nació en Lubbock, Texas, sufrió abusos por parte de dos miembros de su familia cuando tan solo tenía seis años y su vida ha estado marcada por repetidas agresiones sexuales y violencia doméstica.

«Estudios científicos sociales han demostrado que los sobrevivientes de abuso sexual y violencia doméstica, como la señora Lucio, son más vulnerables a producir confesiones falsas bajo tales condiciones coercitivas», agrega el texto.

También destaca que el entonces fiscal de Cameron Armando Villalobos buscó en el caso de Melissa una «victoria» para ser de nuevo elegido y en la actualidad cumple una sentencia de 13 años de cárcel por soborno y extorsión.

Una vida de abusos
En el momento de la muerte de su hija, Melissa tenía 12 hijos –entre los 2 y 15 años de edad– y estaba embarazada de gemelos, que dio a luz en prisión y fueron entregados en adopción.

«El nuevo fiscal de distrito de Texas, los tribunales, la Junta de Indultos y Libertad Condicional de Texas, y el gobernador [de Texas, Gregory Wayne] Abbott deben realizar una revisión significativa del caso de inocencia de Melissa», señala la organización.

Asimismo, hace hincapié en la necesidad de investigar «las tácticas coercitivas utilizadas en el interrogatorio y las circunstancias trágicas, pero accidentales que resultaron en la muerte de Mariah, antes de que ocurra una injusticia irreversible».

La defensa, que tiene nuevas pruebas, presentó una solicitud de clemencia que ha sido firmada por unos 90 legisladores, entre ellos, cuatro miembros del jurado que se han retractado de la decisión que tomaron.
