El Observatorio Social Humanitario (OSH) profundizó, este viernes, junto a representantes de las ONG, en las implicaciones que tendría la aprobación de un instrumento como este, en la labor de las organizaciones de derechos humanos y asistencia humanitaria en el país.
Según cifras de la Oficina de Naciones Unidas para la Coordinación de Asuntos Humanitarios de las Naciones Unidas, la respuesta humanitaria en Venezuela alcanzó en 2021 a 4,5 millones de personas, el proyecto de Ley de Cooperación Internacional amenaza la atención de venezolanos en estado de vulnerabilidad.
La pretensión de imponer una Ley que criminaliza la acción de las Organizaciones No Gubernamentales (ONG) en el país representa una amenaza a la libertad de asociación, la reducción del espacio cívico, a la vez que agrava las condiciones de operación de las distintas organizaciones que trabajan en la atención de los más vulnerables.
Durante su participación, Marianna Romero, directora del Centro para los Defensores y la Justicia (CDJ), aseguró que este tipo de Leyes han sido discutidas e incluso aprobadas en primera discusión en la Asamblea Nacional por parte de actores del chavismo, por lo que no se trata de un instrumento “nuevo”.
Su principal preocupación se centra en los términos tan ambiguos y la discrecionalidad de esta Ley y la arbitrariedad bajo la cual puede ser aplicada, porque a su juicio establece que dependiendo de los intereses que pueda considerar el Ejecutivo generará mayores controles y obstáculos para el desarrollo legítimo de las organizaciones.
“La cooperación internacional es un derecho establecido en la normativa internacional. Más allá de recursos económicos, implica la asistencia técnica y relacionarse con organismos internacionales. El instrumento va en contra de esto porque las organizaciones visibilizan las violaciones a los DDHH y las necesidades humanitarias. Se pretende criminalizar una labor que es plenamente legítima» expresó.
Romero insistió en las consecuencias que esta Ley tendrá en los ciudadanos «cuando se afecta el trabajo de la sociedad, más allá del impacto directo que tiene en las organizaciones, es una violación más a los derechos de las víctimas que ya se encuentran en desprotección. (…) esta amenaza es importante visibilizarla porque las agresiones siguen». En ese sentido, aseguró que en lo que va de año, CDJ ha registrado al menos 98 agresiones este tipo contra organizaciones de la sociedad civil.
Por su parte, Alí Daniels, director de la ONG Acceso a la Justicia calificó el proyecto de Ley como muy confuso por su terminología, y aseguró que tiene falta de coherencia interna para poder hacer una interpretación clara de la norma “pone a la ayuda humanitaria como una de las modalidades de cooperación, como una parte de la ayuda para el desarrollo (…) pero esto es cuando existen elementos de infraestructura y humano que están funcionando en el país. Una emergencia humanitaria implica una inexistencia del Estado donde tiene que prestar servicios fundamentales”.
Sostuvo que en Venezuela hay vacíos del Estado graves en materia humanitaria “la ayuda para el desarrollo no puede ser el género y la ayuda humanitaria la especie, porque son situaciones distintas al igual que sus metodologías de trabajo”.
Daniels alertó sobre cómo esta ley criminaliza la acción humanitaria y la defensa de los derechos humanos, “se pretende la instauración de un registro para las organizaciones para que estas tengan acceso a la cooperación internacional además que ahora cualquier ciudadano puede preguntar por los estatus de las organizaciones, no solo el Estado, y esto es absolutamente arbitrario, es peor que la Providencia contra el terrorismo, porque (…) yo con esto pienso en un colectivo que va a preguntar de dónde sacan el dinero, quiénes los financia, para qué».
Deborah Van Berkel, presidenta de la Red Sinergia, explicó que la Ley busca «controlar recursos económicos, técnicos, de intercambio que puedan realizar de manera autónoma todas las organizaciones de la sociedad venezolana como ONG”.
Detalló que el alcance de esta Ley no solo afecta a las ONG, sino que también medios de comunicación, universidades, organizaciones religiosas y de atención social de iglesias, centros académicos, organizaciones que trabajan con formación política, y redes de organizaciones de base comunitarias que no están registradas formalmente pero que actúan en trabajo social verán limitadas sus funciones de llegarse a aprobar.
«De ser aprobado no es un proyecto más, esto va a generar la consolidación de un sistema político hegemónico, autoritario, que generará muchísimas más dificultades para que Venezuela pueda iniciar un proceso de recuperación y reinstitucionalización hacia la democracia. Más bien va a revertir ese escenario para el futuro de Venezuela. Estamos encarando una limitación para el desarrollo y la atención de necesidades urgentes» insistió Van Berkel.
Enfatizó en que todos los esfuerzos de las organizaciones de la sociedad civil deben dirigirse a impedir que la Ley de Cooperación Internacional sea aprobada.

volunteers in orange T-shirts were going door-to-door to try to persuade voters
to back a ballot measure to inscribe abortion rights in the state constitution — and,
while they’re at it, to vote for Vice President Harris.
To Grace Ireland, a 26-year-old activist, the abortion restrictions imposed by several Republican-controlled states amount to «a public health crisis that Donald Trump and the Republicans have created.»
She added, «Democrats and Kamala Harris are trying to push us forward and protect women’s health care and protect our democracy and protect all people.»

referendums as offering an opportunity to mobilize more people to vote —

But the referendums may not have the clear
impact on the race for the White House that activists hope.
Polls show Trump and Harris running neck-and-neck in Arizona, with the
Republican holding a very narrow lead.
Both ballot questions, meantime, have drawn strong support and both appear likely to pass.
So the abortion issue may not be «helping Democrats in the way that they would hope,» said Jenny Brian, a
professor of bioethics at Arizona State University.
Many Republican women will vote both to protect abortion rights and to bring Trump
back to the White House, Brian said.
Though abortion is sometimes framed as a Democrat vs.
Republican issue, the Republican Party includes «a broad spectrum of views on the topic,» an issue that also raises conservatives’ concerns about «government interference,» she added.
The same dynamic applies to immigration, with the tougher
language on the Arizona ballot question finding support not just among Trump
Republicans but also «moderates and even many Democrats,» said John Kavanagh, a Republican and an Arizona state senator.
