El director presidente de la ONG Foro Penal, Alfredo Romero indicó que de acuerdo a la reforma del Código Procesal Penal (COPP) 67 presos políticos deben quedar en libertad de manera inmediata, pues todos tienen más de tres años privados de libertad de manera preventiva.
Romero detalló que de acuerdo al artículo 230 del COPP el tiempo máximo de detención preventiva es de un año, el anterior a la reforma establecía dos años; los jueces sólo pueden prorrogar un año, «siempre que no exceda la pena mínima prevista para el delito imputado», dijo en rueda de prensa.
La reforma concreta del COPP establece un tope máximo de 3 años y esto debe ser debidamente , justificado por parte del juez, insistió Romero.
Agregó que la detención preventiva- en términos legales- significa que hay condena y como lo establece la Constitución y el COPP, la regla es que los procesos judiciales sean con las personas en libertad, la excepción es cuando hay una medida coercitiva personal y sin embargo, tiene un tope máximo de tres años, detalló Alfredo Romero.
